Rule 100
Committee arrangement
(1) If a civil servant dies due to an accident in the course of government work or needs treatment for injuries or becomes disabled for life, there will be a committee consisting of the following members to recommend the treatment expenses or gratuity to his family or descendants:-
(a) In the case of civil servants of government offices located in Kathmandu Valley –
(1) Representative of the Ministry of General Administration,
(2) Representative of the Ministry of Finance,
(3) Representative of the ministry, secretariat, commission or office where the concerned civil servant is employed.
(b) In the case of civil servants of government offices located in districts other than Kathmandu Valley –
(1) Chief District Officer of the concerned district,
(2) Head of the Treasury and Accounts Controller Office of the respective district,
(3) Head of the office of the concerned deceased employee. But if the chief district officer is the head of the office, then the officer appointed by him.
(2) The committee constituted as per sub-rule (1) shall have the authority to make recommendations as to whether the death of a civil servant has occurred in the course of government work or not and in relation to disability and injury in the course of government work or not.
(3) The recommendation under sub-rules (1) and (2) should be made on the basis of the following documents:-
(a) Evidence of appointment or visit order for Government work,
(b) Surgemin Muchulka or Police Report,
(c) a document or will of the hospital where the treatment was given,
(d) Recommendation of the civil servant employment agency to be treated.
(4) In accordance with sub-rule (2) of rule 97, the recommendation of the committee as per sub-rule (1) shall be considered as the basis even when additional sick leave is approved. Explanation:- For the purpose of these rules, the term 'conduct of Government work' shall mean the following conditions unless otherwise proved:-
(a) at any time while going to and returning from office or engaged in office work at any place within or outside office hours,
(b) In the case of being assigned to work elsewhere for government work, throughout the work period.
(5) EqWhen determining whether or not he has met with an accident in the course of official work, if he recommends that the accident has taken place in the course of official work without the documents as per sub-rule (3), based on such recommendation, the amount for the benefits received by the concerned civil servant or his family shall be collected from all the members of the committee by Damasahi. Departmental action may also be taken against them according to the prevailing law.
(6) If it is proved that the recommendation as per sub-rule (5) is wrong, then the facility that the concerned employee or his family is getting according to such recommendation will not be given.
